BeCA warns about pilot (and cabin crew) contracts breaching Belgian law

Dear colleagues,
You will find here the full letter sent by BeCA to Ryanair management, pointing out several instances where our legal advisors identified RYR contractual clauses breaching Belgian labour law.
Regarding sickness leave, it is NOT legal to ask you about the reasons of your sickness (this is a private matter) , nor to compensate a sick day by taking away a day off. Regarding disciplinary meetings, we have asked Ryanair to no longer organise disciplinary meetings in Ireland and to allow for proper union representation.
Please note that signing a contract containing clauses that are null and void does not bind the employee with respect to these clauses. But of course, this will require individual proceedings in case of litigations and we prefer to rapidly get full clarification/action from the Authorities.
